Terms and Conditions for Nutrify
Welcome to Nutrify!
These Terms of Service (Terms) govern your use of the Nutrify website and mobile applications (collectively, the Service) provided by Nutrify. By using our Service, you agree to these Terms.
1. Description of Nutrify
Nutrify is an AI-powered calorie and diet tracker that allows users to track meals, calories, and nutritional information. It provides features such as food recognition through image capture, personalized meal plans, and progress tracking.
2. User Accounts and Subscriptions
2.1 Account Creation: You must create an account using Google Sign-In or Apple Sign-In to use our Service. You are responsible for maintaining the security of your account.
2.2 Subscription Plans: Nutrify offers the following subscription options:
- Monthly Plan: $9.99/month, auto-renewing
- Annual Plan: $35.99/year (70% savings compared to monthly), auto-renewing
- Lifetime Access: $39.99 one-time payment, no renewal
- Special Offer (Downsell): $2.99/month, available under certain conditions
2.3 3-Day Free Trial: New users who decline paid subscriptions may be offered a 3-day free trial. This trial is limited to one per user account and will be tracked to prevent abuse. Trial access ends after 3 days, after which you must subscribe to continue using premium features.
2.4 Payment Processing: All subscriptions are processed through Apple In-App Purchase (iOS) or Google Play Billing (Android). We do not store your payment information. Billing is handled entirely by Apple or Google according to their respective terms.
2.5 Cancellation and Refunds: You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Subscription fees are generally non-refundable except where required by law. Cancellation takes effect at the end of your current billing period.
2.6 Price Changes: We reserve the right to modify subscription prices with at least 30 days notice. Price changes will apply to your next billing cycle after notification.
2.7 Subscription Expiration: If your subscription expires or is cancelled, you will lose access to premium features but retain access to basic features. Your data will be retained according to our Privacy Policy.
3. User Data and Privacy
3.1. We collect and store various types of user data, including but not limited to: personal information, food images, meal logs, nutritional data, usage patterns, and payment information.
3.2. By using our Service, you grant Nutrify the right to use your uploaded content (including images and data) to improve our AI models, enhance our services, and conduct research and development.
3.3. We may share anonymized and aggregated data with third parties for analytics, research, or commercial purposes. This data will not contain personally identifiable information.
3.4. Your data is stored securely in our databases and cloud storage services (including Amazon S3). We implement industry-standard security measures to protect your information.
4. User-Generated Content
4.1. You retain ownership of content you upload, but grant Nutrify a worldwide, non-exclusive, royalty-free license to use, modify, adapt, reproduce, and distribute this content for:
- Providing and improving our services
- Training and enhancing our AI models
- Marketing and promotional purposes
- Research and development activities
- Creating aggregated analytics and insights
4.2. You are responsible for ensuring you have the right to share any content you upload and that it doesn't violate any third-party rights.
5. AI and Data Processing
5.1. Our AI systems process user-uploaded images and data to provide nutritional analysis, recommendations, and insights. While we strive for accuracy, results should be considered estimates.
5.2. You acknowledge that our AI models are continuously learning and may be trained using anonymized user data, including your uploaded content.
5.3. We may share anonymized data with research partners or use it to publish scientific papers and studies related to nutrition and AI technology.
6. Intellectual Property
6.1. All intellectual property rights in the Service, including our AI technology, algorithms, software, and databases, remain the property of Nutrify.
6.2. Any insights, improvements, or innovations derived from analyzing user data belong to Nutrify, while protecting user privacy and confidentiality.
7. Health Disclaimer
7.1. Nutrify is not a substitute for professional medical advice, diagnosis, or treatment. Always consult healthcare professionals for medical decisions.
7.2. We do not guarantee specific health or weight management outcomes from using our Service.
8. Limitation of Liability
8.1. Nutrify is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
8.2. Our maximum liability for any claims shall not exceed the amount you paid for the Service in the previous 12 months.
9. Account Termination and Data Deletion
9.1 Termination by Company: We reserve the right to suspend or terminate your account for violations of these Terms, abusive behavior, fraudulent activity, or for any other reason at our discretion, with or without notice.
9.2 Termination by User: You may delete your account at any time by going to Settings > Account Management > Delete Account in the mobile app. This action is permanent and cannot be undone.
9.3 Data Deletion: Upon account deletion:
- Your profile information, meal logs, food images, exercise data, and all personal information will be permanently deleted within 30 days
- Active subscriptions will be cancelled (no refunds for unused subscription time)
- You will receive a confirmation email at your registered email address
- Some data may be retained for legal compliance (e.g., financial records, fraud prevention) or in anonymized form for analytics
9.4 Data Export: Before deleting your account, you may export your data via Settings > Account Management > Export My Data to receive a copy of your information in JSON format.
10. Email Communications
By creating an account, you consent to receive product updates, tips, educational content, and feature announcements via email. These communications are designed to help you get the most out of Nutrify and support your health goals.
You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email, or by toggling email preferences in the app settings. Transactional emails (account security, billing) will continue regardless of your marketing preferences.
11. Changes to Terms
We may update these Terms periodically. Users will be notified of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
